This Privacy Statement explains why and how FrieslandCampina collects, uses, transfers, secures your Personal Data as a job applicant 

Why and how do we use your Personal Data?

‘Personal Data’ is information that directly or indirectly tells us something about you. We need to process your Personal Data when you apply for a job at FrieslandCampina or when you are contacted by a FrieslandCampina recruiter to spark your interest about selected FrieslandCampina vacancies. 

The Personal Data we process includes your contact details (for example, name, e- mail, phone, address) and/or other relevant information (for example, content of curriculum vitae or LinkedIn profile like education, certificates or job history). More Personal Data may be processed for specific positions (for example, driving license, assessments or test) or to comply with legislation.

We will use your Personal Data for several purposes:

  • To facilitate the candidate application process (for example; candidate application on our website, general interaction with you on your application);
  • The screening and selection process (for example; evaluating candidates qualifications through candidate CV, screening call, interview and assessment of capabilities- for certain roles);
  • Proactively recruiting talent (for example; contacting candidates & creating candidate pipeline via Linkedin);
  • Contracting and onboarding (for example; after a successful application - using candidates Personal Data to create an employment agreement or setup IT accounts);
  • Analytics and internal reporting on a aggregated level (for example, reporting on hired and rejected candidates and turnaround times). 

The legal basis for processing your Personal Data?

We can only process your Personal Data if we have a valid legal basis. For purposes explained in this Privacy Statement we process your Personal Data based on the following grounds:

  • Based on our legitimate interests (when our recruiters actively approach candidates on LinkedIn to discuss potential job opportunities). We have made an assessment balancing our legitimate interests (actively recruiting and approaching potential talent) and the protection of Personal Data in respect of your interests, fundamental rights and freedoms;

     
  • Based on your consent (for keeping your Personal Data for longer than 4 weeks after an application procedure to inform you about new vacancies). You have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.;

     
  • Based on conducting necessary steps for entering into an employment contract (when we offer you an employment contract). If we cannot process your Personal Data based on this ground,  we might not be able to employ you.


     

     

Who has access to or receives your Personal Data?

Only authorized FrieslandCampina personnel involved in the application process has access to your Personal Data. Examples are the Hiring Manager, People Advisor and the recruiter. There can be reasons for FrieslandCampina to share your Personal Data with third parties. Examples of third parties which we may share your Personal Data with are:

  • Matching and selection platforms;
  • Talent Acquisition and Recruitment Platforms;
  • Applicant Tracking Systems;
  • Analytics Platforms. 

All third parties are selected carefully before any Personal Data is shared. We have made arrangements with these parties about the protection and security of your Personal Data. When these third parties act as a 'Processor' we have entered into a Data Processing Agreement (DPA) with them, in other cases they process your Personal Data as an ‘individual controller’. In this case, these companies are responsible for the Personal Data they receive and should inform you separately on their processing activities via a Privacy Statement. 

In addition to the third parties we have selected ourselves, your Personal Data may also be shared with Tax Authorities and other government institutions if this is required by law.

International Transfers

If you are located in the European Economic Area (EEA), FrieslandCampina reserves the right to transfer your personal data to a country or international organization outside the European Economic Area. If this is the case, we will ensure that the appropriate, suitable and required safeguards and transfer mechanisms shall be in place, like Standard Contractual Clauses. You are entitled to receive a copy of any documentation showing the suitable safeguards that have been taken by making a request via Privacy@frieslandcampina.com

How do we protect your Personal Data?

FrieslandCampina is committed to protecting the security of your Personal Data. We have taken several security measures to help protect your Personal Data from unauthorized access, use, or disclosure:

  • We check on a regularly base if the Personal Data that we contain is still accurate, complete and up to date. We facilitate you in ways to keep your data up to date as well.
  • We delete or anonymize all Personal Data which we no longer need for business purposes.
  • FrieslandCampina has an information security framework and policies in place to protect your Personal Data from being misused, altered or disclosed to unauthorized persons.
  • Only specially authorized staff will be allowed to process your Personal Data and they are obliged to treat them confidential.
  • We only provide your data to third parties if we have a written contract with them. This contract contains clauses protecting your information.
  • The conditions we apply are even stricter if the third party is in a country where data protection is not considered to be adequate.

How long does FrieslandCampina retain your Personal Data?

FrieslandCampina stores your Personal Data as long as necessary for the application process, with a maximum of 4 weeks after the process is completed. When applying you can consent that we keep your information for 12 months to receive information about new vacancies.

Your Data Subject Rights

 

Under Privacy laws you may have a number of so called Data Subject Rights or DSR’s. Your requests can be send to GlobalTalentAcquisition@frieslandcampina.com. We may decline requests that are unreasonable or may jeopardize the privacy of others or when we cannot establish your identity. We may also decline requests for which access is not required by local law.

The right to be informed & the right of access: you have the right to know if we process your Personal Data and if so, access it and retain a copy.

 

The right to rectification: if your Personal Data is incorrect or incomplete you can ask us to correct it.

The right to object (only when processing under our legitimate interest): In this case, we will not process any of your Personal Data upon your objection, unless we can provide you with compelling reasons to continue the processing of your Personal Data.

The right to restrict processing: In case of the following reasons you can request us to restrict the processing of your Personal Data. Please not that we cannot process your Personal Data unless your grant us permission.

 

  • You think that the processing of your Personal Data by us is unlawful;
  • You contest the accuracy of your Personal Data; 
  • You require the Personal Data for legal claims after the retention period;
  • You have objected to the processing of your Personal Data. 


The right to erasure: If you want us to delete your Personal Data, you have the right to request us to delete your Personal Data. However, this is not an absolute right; we will delete your Personal Data, unless we have a valid reason to keep processing your Personal Data.

The right to data portability (when processing under consent or performance of contract): You can request us for an export of all the Personal Data that is processed by us. 

 

Right to human intervention: In some limited cases (a number of traineeships), we could make use of automated decision making, hard requirements are that you have finished a Masters degree before the start of the traineeship. Furthermore, for some limited traineeships we require that you are fluent in Dutch. 

If you are automatically rejected because you do not fit these requirements, you can ask for a so called ‘human intervention’ by sending your request to GlobalTalentAcquisition@frieslandcampina.com. In that case a Talent Specialist will review your automated rejection manually. However, please note, that if you do not fit these 2 requirements, the outcome will not be any different. 

Who can I contact if I have questions, concerns or complaints?

When you have any questions, concerns or complaints about the use of your Personal Data you can always contact our Talent Acquisition team on GlobalTalentAcquisition@frieslandcampina.com. You are also welcome to contact our Global Privacy Manager/Data Protection Officer on privacy@frieslandcampina.com. Finally, you may also file a complaint with your local data protection authority.
